WAIVER & AGREEMENT:
By indicating your acceptance, you understand, agree, warrant and covenant as follows:

FUNDRAISING COMMITMENT BREAKDOWN BY CATEGORY:

- As a 2026 Bank of America Chicago Marathon Team Member, I agree to raise reach the $1,000 milestone in my fundraising by May 1st, 2026.

- As a 2026 Bank of America Chicago Marathon Team Member, I agree to raise a minimum of $2,500 by October 4th, 2026. If you have not met the minimum by this date your credit card will be charged the remainder.

- When you complete this registration you will be charged a $100 Sign Up fee. This fee helps to cover the cost of your training shirt, your race day shirt, and our team gathering on race weekend.

- By signing this form and joining the team you are committing to raise the minimum amount. If the goal/commitment is not met for the by the set date, your name will not be submitted for entry into the race, no exceptions. 

- Please know that the Semper Fi & America's Fund (SFAF) Team will help you every step of the way to reach your goal. We will provide you with several suggestions and proven ways to reach your goal, but you must be willing to do the work on your end to solicit donations.

- I agree to check my email on a regular basis and be responsive to the Semper Fi & America's Fund Community Sports Staff. 

- I agree to attend 2 mandatory team Zoom calls.

- I understand that when I have reached the $1,000 milestone in my fundraising, the Semper Fi & America's Fund staff will approve my registration in the Haku Sports platform and at that time my credit card on file will be charged the race registration fee for the 2026 Bank of America Chicago Marathon.

CANCELLATION POLICY:  Once registered, you are responsible for raising the fundraising minimum, even if for any reason, including injury or illness, you are unable to participate in the event. You must contact the SFAF race manager - Elizabeth O'Connell - elizabeth.oconnell@thefund.org as early as possible in writing if you are not able to participate. Any monies that have been collected from you before you leave the team are nonrefundable.

TRANSPORTATION: Athletes are responsible for their transportation and hotel costs.

As part of the Semper Fi & America's Fund Team, you will receive entry into the 2026 Bank of America Chicago Marathon Team amenities include training resources, fundraising support (including a personal online donation page), a pre-race get together, runner's goodie bag, and a team shirt in exchange for your fundraising efforts. 

As a Semper Fi & America's Fund Team member, I will serve as an ambassador for Semper Fi & America's Fund and in no official capacity as an employee, consultant, and talent or otherwise, unless directly asked by Semper Fi & America's Fund to serve in that capacity. If asked to serve, it does not supersede my conduct, or obligations that I agree to in this member agreement.

Misrepresentation of myself as an employee or consultant will be grounds for immediate removal from the team. As a team member I will be mindful that I am representing Semper Fi & America's Fund and will conduct myself accordingly. I understand and agree that all funds raised as a team member will go to Semper Fi & America's Fund, and, if for any reason, I do not participate in the event I have raised funds for; that those funds are non-transferable and non-refundable and remain donations to Semper Fi & America's Fund. I will also not hold Semper Fi & America's Fund, or any of their representatives, responsible for any injures either during training or during the Marathon, and I am running of my own free will. I have read the above and understand the fundraising benchmarks, due dates and conduct guidelines. I agree to these Semper Fi & America's Fund terms.

PHOTO RELEASE FOR THE SEMPER FI & AMERICA'S FUND

For consideration which I acknowledge, I irrevocably grant to Semper Fi & America's Fund (SF&AF) the absolute right and permission to publish, copyright and use pictures of me in which I may be included in whole or in part, composite or retouched in character or form.

My permission covers all forms of media, including but not limited to, SF&AF’s website, newsletters, social media, and promotional materials. I waive the right to inspect or approve versions of my image used for publication or the written copy that may be used in connection with the images.

I hereby further grant permission to SFAF to use, or authorize others to use, any photographs, motion pictures, recordings, or any other record of my participation in the event as a member of the SFAF for any legitimate purpose.

I release Semper Fi & America's Fund, its assigns, licensees and successors from any claims that may arise regarding the use of my image including any claims of defamation, invasion of privacy, or infringement of moral rights, rights of publicity or copyright. SF&AF is permitted, although not obligated, to include my name as a credit in connection with the image.

RELEASE FORM AND CONTRIBUTION AGREEMENT: 

I acknowledge that participating in a marathon, half marathon, cycling event or triathlon as a member of the Semper Fi & America's Fund Team, including pre-event training and related team activities is a potentially hazardous activity. I hereby agree not to participate unless I am medically able and properly trained. I agree to abide by any decision of an event official relative to my ability to safely complete the event. I am voluntarily entering and assume all risks associated with participating in this event. 

Having read this waiver and knowing these facts, and in consideration of my acceptance of this application, I, for myself, and anyone entitled to act on my behalf, waive and release the Semper Fi & America's Fund and its representatives and successors, officers, directors, members, agents, and employees from all present and future claims and liabilities of any kind, known or unknown, arising out of my participation as a member of the 2026 Bank of America Chicago Marathon Team even though that liability may arise out of ordinary negligence or fault.

I have read and understood this agreement and I am over the age of 18. This agreement expresses the complete understanding of the parties.
