USO WAIVER, RELEASE,
AND GRANT OF RIGHTS AGREEMENT
In consideration of
my being permitted to participate in the 2026 Chicago Marathon as part of “Team USO,”
and in related events and activities (collectively, the “Event”), I hereby
acknowledge on behalf of myself, my heirs, personal representatives, and/or
assigns that I will be engaging in running, which involves potential dangers
and risks, including, without limitation, injury, permanent disability, and
death, that may result not only from my own actions, inactions, or negligence, but the actions,
inactions, or negligence of others. I acknowledge that some of these risks
and dangers cannot be eliminated, regardless of the
care taken to avoid them. I hereby: (1) agree to assume full responsibility
for any and all risks, injuries, or damages that I sustain or aggravate by
participating in the Event; (2) assume all of the foregoing risks and accept
personal responsibility for all expenses, medical or otherwise, following
any such damages,
injury, permanent disability,
or death; (3) release, indemnify, and hold harmless the United Service
Organizations, Inc., its affiliates, officers, directors, employees,
volunteers, representatives, agents, successors, assigns, independent
contractors, and sponsors, from any and all liabilities to me, my heirs, and
personal representatives for any and all claims, demands, actions, suits,
procedures, costs, expenses, losses, or damages arising out of or in any way
related to my participation in the Event; and (4) represent that I: (a) have no
medical, physical, or mental condition that would prevent me from participating
in the Event, and (b) have not been instructed by a health care provider to
refrain from participating in the Event.
In consideration for being provided the opportunity to participate in the Event, I give the United Service Organizations, Inc., its affiliates, licensees, and each of their respective officers, directors, employees, shareholders, representatives, agents, successors, and assigns (collectively, “USO”), my permission to be photographed, videotaped, and/or recorded while participating in or attending the Event. USO shall retain ownership and publication rights to all such photographs, videos, and/or recordings (collectively, the “USO Materials”), and I authorize USO to use, publish, reproduce, and disclose the USO Materials for archival, promotional, marketing, and advertising purposes, and for purposes of fundraising, public awareness, and public outreach concerning USO’s charitable mission, programs, services, and activities, on all of USO’s digital and social media platforms, websites, public service announcements, press/media releases, and marketing, promotional, and print materials (collectively, the “Authorized Uses”). I grant USO the irrevocable and unrestricted right, in perpetuity, to use and publish my name, voice, likeness, image, and biographical information in connection with the Authorized Uses in any and all media. I also grant USO the right to alter the same without restriction and without my inspection or approval. I further agree that USO will own any and all rights, including, but not limited to, derivative rights in the USO Materials. I release and hold harmless the USO from any claims, damages, demands, or liabilities, including, but not limited to, misappropriation, right of publicity, and invasion of privacy, arising out of or resulting from the Authorized Uses or any rights and consents granted herein. I waive any right to any payment or compensation for the rights and consents granted herein.
I hereby represent
that: I am 18 years of age or older, have read this USO Waiver, Release, and
Grant of Rights Agreement (“Agreement”), fully understand its terms, and
understand that I am giving up substantial rights — including my right to sue USO under certain circumstances — by signing
it. I acknowledge that I am signing
this Agreement freely and
voluntarily. The term of this
Agreement is indefinite.
USO Fundraising Agreement for the 2026 Bank of America Chicago Marathon
Fundraising Agreement:
In consideration of receiving an entry into the 2026 Bank of America Chicago Marathon (the “Marathon”) and being permitted to participate as part of “Team USO,” I agree to personally donate and/or fundraise from third-party donors a minimum of two thousand and two hundred dollars ($2,200) (the “Minimum Fundraising Amount”) by October 18, 2026 (the “Fundraising Deadline”) for the benefit of the United Service Organizations, Inc. (“USO”). By signing this USO Fundraising Agreement (“Agreement”), I unconditionally commit to donate or fundraise the full Minimum Fundraising Amount by the Fundraising Deadline, regardless of any change in my ability, intent, or desire to participate in the Marathon, and regardless of illness, injury, financial hardship, or other extenuating circumstances. I also agree that any additional funds that I raise above the Minimum Fundraising Amount will be donated to the USO. I further agree that if I do not meet the Minimum Fundraising Amount by the Fundraising Deadline, then USO may charge the credit card that I have on file through Haku.com for any remaining balance. However, if I raise additional funds for USO after my credit card has been charged by USO, then I understand that USO will reimburse my credit card to the extent that I cover the Minimum Fundraising Amount, upon receipt of my written request for a refund.
Marathon Fees:
I agree to register for the Marathon and pay all applicable Marathon processing and entry fees charged in connection with registering for the Marathon, including a $250 application fee. I agree that this application fee is not credited against, and is in addition to, my Minimum Fundraising Amount for Team USO.
Cancellation Policy:
I agree that I am solely responsible for raising or personally donating the entire Minimum Fundraising Amount by the Fundraising Deadline, even if I am unable to participate in the Marathon for any reason, or I cancel my Marathon registration.
Marathon Rules:
I agree that: I will not begin the Marathon
prior to the official start time; I will not compete in a manner which, in the
judgment of the Marathon officials, interferes with Marathon operations or
other participants; and I will not reproduce or transfer my official bib
number. I understand and agree that charity-guaranteed entries to the Marathon cannot
be deferred. I also understand that registering for the Marathon is separate
from any team paperwork that USO and/or the Marathon may require me to complete.
I have read this Agreement, fully understand its terms, and acknowledge that I am signing it freely and voluntarily.
