By signing this waiver, I have read the terms and conditions contained herein and agree to abide by such terms and conditions. 

● Fundraising Requirements. I am required to meet the minimum fundraising requirement of $2,200 for The Morton Arboretum. 25% of the fundraising minimum must be reached by March 1, 2026, 50% by June 15, 2026, and 100% by October 1, 2026. My failure to meet these minimums by such dates will result in my credit card being charged for any respective differences owed on March 2, 2026, June 16, 2026, and October 2, 2026. The Morton Arboretum has the authority to cancel my 2026 Bank of America Chicago Marathon registration if I fail to fulfill my fundraising commitment. 

● Injuries and Illnesses. The Morton Arboretum will be charged for my registration whether or not I run and my entry cannot be deferred, donated, refunded or transferred if I do not run. In the event I am unable to run due to injury, I agree to raise a minimum of 50% ($1,100) of the fundraising requirement for The Morton Arboretum to offset the costs of my registration and otherwise support The Morton Arboretum. This amount is due no later than June 15, 2026. 

● Race Details. I will be responsible for abiding by all rules and regulations promulgated by the event organizers in connection with the marathon, including the time limits and age requirements. 

● License. I grant a perpetual, royalty-free license to The Morton Arboretum to use my name, image and/or likeness for the purpose of promoting Team Morton Arboretum in any manner worldwide-- either in print material, radio, television broadcast or online. 

● Waiver and Release. I acknowledge that I have voluntarily agreed to participate as a Team Morton Arboretum runner in the 2026 Bank of America Chicago Marathon. I agree that I and/or my heirs, guardians, legal representatives, successors, distributes, and assignees will not make a claim against, sue, attach a property of, or prosecute The Morton Arboretum or any of its affiliated organizations, staff, Board or agents for any losses, injury, death, or property damage occurring to me as a result of my participation (either directly or indirectly) in any of the activities related to training and running with Team Morton Arboretum whether caused by negligence of Team Morton Arboretum, or otherwise. Without limiting the generality of the foregoing, I agree to the Waiver attached hereto as Exhibit A. 

● Entry. I am NOT guaranteed entry into the 2026 Bank of America Chicago Marathon by completing and submitting this Participation Waiver form. Guaranteed charity entries are limited and are available on a first-come, first-served basis. When the number of spots allocated to The Morton Arboretum is depleted, entry through this process may no longer be available. If selected for guaranteed entry through The Morton Arboretum, I understand there may be additional details and paperwork provided by The Morton Arboretum in order to participate as a Team Morton Arboretum runner and there may be required registration separate from any paperwork provided by The Morton Arboretum. 

● Non-Refundable. Charity guaranteed entries for the 2026 Bank of America Chicago Marathon are non-refundable, non-transferable, and may not be deferred to future years. I AM AWARE OF, ACKNOWLEDGE AND AGREE THAT THE WAIVERS, RELEASES, INDEMNITIES AND AUTHORIZATIONS CONTAINED IN THIS DOCUMENT ARE LEGALLY BINDING UPON ME AND THAT I AM WAIVING AND RELEASING THE LEGAL RIGHTS EXPRESSED HEREIN. I EXPRESSLY ACKNOWLEDGE AND AGREE THAT THIS DOCUMENT IS INTENDED TO BE AS BROAD AND INCLUSIVE AS MAY BE PERMITTED BY LAW AND THAT IF ANY PORTION OF THIS DOCUMENT IS HELD TO BE INVALID, THEN THE BALANCE OF SAME SHALL CONTINUE IN FULL LEGAL FORCE AND EFFECT. 

Exhibit A 

THE MORTON ARBORETUM – BANK OF AMERICA CHICAGO MARATHON WAIVER 

THE MORTON ARBORETUM is committed to participating in the 2026 Bank of America Chicago Marathon event in a safe manner and holds the safety of the runners participating in Team Morton Arboretum in high regard. The Morton Arboretum strives to reduce risks associated with this event and, accordingly, insists that all participants follow all safety rules, instructions and directions of staff and race officials. However, participants must recognize the inherent risks of injury when choosing to participate in the Chicago Marathon, which is a running/ walking event utilizing public roadways and walkways. You are solely responsible for determining if you are sufficiently fit and skilled physically and mentally to participate safely in the Bank of America Chicago Marathon. You are advised, especially if the participant is pregnant, disabled in any way, suffer from or recently suffered from an illness, injury or other impairment, to consult a physician before participating in the Bank of America Chicago Marathon. You are also solely responsible for deciding what, if any, protective helmets, shoes, clothing and other equipment will be worn by you. 

You are also warned and requested to recognize and remember the following:

1. Roadways are constructed and maintained for use by motor vehicles and are not intended to be used by pedestrians. Cracks, potholes, uneven surfaces and other irregularities pose serious risks of injury and even death to participants. It is recommended that participants familiarize themselves with the Bank of America Chicago Marathon course and the condition of the course roadway surface prior to the event. 

2. The Bank of America Chicago Marathon is intended to challenge and engage the physical, mental and emotional resources of the participants. Even with careful and proper preparation, conditioning, instruction, medical advice, and equipment, there remains a risk of serious injury and death when participating in a running/walking event utilizing sidewalks and roadways. 

3. Not all risks and dangers can be foreseen. Participants are reminded that risks, dangers, hazards and resulting injuries and death can also exist because of many circumstances inherent in outdoor running and walking activities utilizing roadways and walkways. Accordingly, The Morton Arboretum is not responsible for and does not guarantee anyone’s safety. 

4. Any accident, injury, death, and damage arising out of or relating to participation in the Bank of America Chicago Marathon by the participant shall be and is the sole liability and responsibility of the participant. 

In consideration of being allowed to participate in the Bank of America Chicago Marathon, the undersigned, for himself, herself and for his or her minor children/wards, hereby AGREES TO AND DOES FOREVER DISCHARGE AND RELEASE THE MORTON ARBORETUM, ITS OFFICERS, DIRECTORS, EMPLOYEES AND VOLUNTEERS FROM ANY AND ALL LEGAL LIABILITY AND TO NOT SUE THE MORTON ARBORETUM AND ITS OFFICERS, DIRECTORS, EMPLOYEES AND VOLUNTEERS FOR ANY INJURY, DEATH, OR PROPERTY DAMAGE CAUSED BY OR DIRECTLY OR INDIRECTLY ARISING FROM THE PARTICIPATION BY PARTICIPANT IN THE BANK OF AMERICA CHICAGO MARATHON. THIS INCLUDES BUT IS NOT LIMITED TO INJURIES, DEATH, OR PROPERTY DAMAGE ARISING FROM NEGLIGENCE BY THE MORTON ARBORETUM, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND VOLUNTEERS. 

FURTHER, PARTICIPANT HEREBY AGREES TO HOLD HARMLESS THE MORTON ARBORETUM, ITS OFFICERS, DIRECTORS, EMPLOYEES AND VOLUNTEERS OF AND FROM ANY AND ALL LIABILITY OF ANY NATURE WHATSOEVER AND FROM ALL DEATH, INJURIES OR SICKNESS TO PARTICIPANT OR DAMAGES WHICH MAY BE SUFFERED BY PARTICIPANT DURING HIS/HER PARTICIPATION IN THE BANK OF AMERICA CHICAGO MARATHON AND FROM ANY ACT OR FAILURE TO ACT OF THE MORTON ARBORETUM, ITS OFFICERS, DIRECTORS, EMPLOYEES AND VOLUNTEERS. FURTHER, PARTICIPANT HEREBY INDEMNIFIES THE MORTON ARBORETUM, ITS OFFICERS, DIRECTORS, EMPLOYEES AND VOLUNTEERS FROM ANY CLAIMS THAT MAY ARISE OR BE RELATED TO THE PARTICIPATION BY PARTICIPANT IN THE BANK OF AMERICA CHICAGO MARATHON. THIS INCLUDES BUT IS NOT LIMITED TO ALL CLAIMS FOR COMPENSATION, BODILY INJURY, DEATH, PROPERTY DAMAGE, COSTS, EXPENSES, AND ATTORNEY’S FEES, WHETHER OR NOT ARISING OUT OF THE NEGLIGENCE OF THE MORTON ARBORETUM, ITS OFFICERS, DIRECTORS, EMPLOYEES AND VOLUNTEERS.
